Last Updated: March 31, 2007 EmailsForAds is offered to you conditional to your acceptance, without modification on your part, of the terms and conditions contained herein. Your use of the EmailsForAds program constitutes your agreement to all such terms and conditions. Modification of These Terms of Service EmailsForAds reserves the right to change the terms and conditions without prior notification of its members. You are responsible for regularly reviewing these terms and conditions. Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with EmailsForAds. If any modification is unacceptable to you, you're only recourse is to terminate this agreement. Your continued participation in the EmailsForAds program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change. Privacy and Protection of Personal Information Please review the Privacy Policy at http://www.emailsforads.com/pages/privacy.php for disclosures relating to the collection and use of your personal information. General EmailsForAds may provide you with notices, including those regarding changes to the terms, by either email, regular mail, or postings on the website. EmailsForAds reserves the right to disclose any personal information about you or your use of the EmailsForAds website/services, including its contents, without your prior permission if EmailsForAds has a good faith belief that such action is necessary to: conform to legal requirements or comply with legal process; protect and defend the rights or property of EmailsForAds; enforce the terms or service; or act to protect the interests of its members or others. EmailsForAds reserves the right to limit signups at any time. Entire Agreement The Terms of Service constitute the entire agreement between you and EmailsForAds and govern your use of the program/services, superceding any prior agreements between you and EmailsForAds. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other affiliate services, third-party content or third-party software. Non-Transferable You agree that your EmailsForAds account is non-transferable. Any rights to your EmailsForAds username or contents within your account terminate upon your death. Points and/or earnings may not be sold. Member Participation Terms You must be 13 years of age or older. Minors must submit written and signed parental consent to participate in this program. Our program is open to both US and International members and is void where prohibited by local governing laws. You must be able to read and understand English. If you cannot read and understand English, please do not sign up. You must complete the registration process by providing us with true, accurate, current and complete information about yourself as prompted by the applicable registration form and may not assume a false identity. You must maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or EmailsForAds has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, EmailsForAds has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof). You may not signup multiple times with different email addresses. Your computer must not be shared with another individual that has an existing EmailsForAds account. EmailsForAds allows only ONE account per household. You will use your email address/password combination to access your account, it is your responsibility to keep this information confidential, and you may change this information by logging into your EmailsForAds account and clicking on the "Account Info" link. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify EmailsForAds immediately of any unauthorized use of your account or any other breach of security. EmailsForAds will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by EmailsForAds or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder. You must maintain your email account that you used when signing up EmailsForAds. You agree to receive advertising from EmailsForAds. In the event your email account on file becomes closed or blocked for 7 (seven) or more days to messages from EmailsForAds your account will be terminated and you will forfeit all prior earnings. In the event your email account on file is full for 7 (seven) consecutive days your account will be terminated and you will forfeit all prior earnings. If your account becomes inactive for a period of 30 (thirty) days, it may be terminated without notice and all earnings forfeited. You understand that in some cases there may be delay in crediting rewards due to advertiser's failure to provide necessary information to EmailsForAds for such crediting of rewards. EmailsForAds will not be responsible or liable for the delay or failure to credit rewards in such event. EmailsForAds reserves the right to adjust your account balance for items returned or transactions not completed or cancelled. A pattern of placing orders followed by cancellations is construed as purchasing fraud and could result in the termination of your EmailsForAds account. Unlawful or Prohibited Use You agree not to abuse your privileges by conduct which is detrimental to the interests of EmailsForAds, including without limitation attempting to accrue earnings or redeem earnings in a manner inconsistent with the rules of EmailsForAds or intent of this Agreement; having multiple accounts; attempting to earn through other than legitimate channels, including the use of software designed to extract tracking links from emails or the website and using the source code to click links; participating in purchasing or redemption fraud; or tampering with EmailsForAds tracking links. Turning off images in your browser or using Ad Blocking Software is not allowed. This does not apply to the use of popup blockers. You may not use EmailsForAds in any manner that could damage, disable, overburden, or impair EmailsForAds or interfere with any other party's use and enjoyment of EmailsForAds. You may not attempt to gain unauthorized access to EmailsForAds or other accounts connected to EmailsForAds, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the EmailsForAds program. Any solicitation of advertisers for a confirmation email for purposes of receiving credit in your account will be grounds for immediate termination. Threatening or abusive actions may result in account termination and forfeiture of all earnings and referrals. Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by EmailsForAds be detected it may result in member termination and possible legal action. Relationship of the Parties You and EmailsForAds are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and EmailsForAds. You understand that you do not have authority to make or accept any offers or make any representations on behalf of EmailsForAds. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the EmailsForAds program. Links to Third Party Sites EmailsForAds may contain images of and links to third party websites. EmailsForAds is not responsible for the contents of any third party website, including without limitation any link contained in a third party website, or any changes or updates to a third party website. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. EmailsForAds shall not be responsible or liable for any part of any such dealings or promotions. Payments Members may earn by receiving and reading paid emails, and visiting the advertiser's websites after they have entered their member ID in the area on the website provided by EmailsForAds. Members may earn by taking advantage of earning opportunities on the EmailsForAds website and by responding to offers from participating advertisers via email or postal mail. Members may earn by referring new members to the EmailsForAds program. Members will earn 25% of their direct referrals earnings, 15% of their 2nd level referral earnings, 10% of their 3rd level referral earnings, 10% of their 4th level referral earnings, 5% of their 5th level referral earnings and 1% of their 6th - 15th level referral earnings. Members may redeem points for advertising or services as defined in the Members Area. Members may redeem cash earnings for gift certificates, PayPal, Check/Money Order, or eGold (when available) when their account balance reaches $5 and they request payment. Members must earn at least 50 cents in personal earnings per cashout. Personal earnings for this purpose includes rewards earned through the shopping portal. Payments will be made within 90 days after the payment request is received. Liability Disclaimer The information and services included in or available through EmailsForAds may include inaccuracies or typographical errors. Changes are periodically made to EmailsForAds and to the information therein. EmailsForAds may make improvements and/or changes at any time. EmailsForAds makes no warranty that the program/services will meet your requirements, the program/services will be uninterrupted, timely, secure, or error-free, the results that may be obtained from the use of the program/services will be accurate or reliable, and any errors in the software will be corrected. EmailsForAds is under no obligation to provide members with any particular number of earning opportunities or send messages to them. EmailsForAds will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or EmailsForAds program, even if EmailsForAds has been advised of the possibility of such damages. Furthermore, EmailsForAds aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement. EmailsForAds is not responsible and assumes no liability for changes or discontinuances of service from providers which may affect offers or the accrual of earnings. Termination/Access Restriction EmailsForAds reserves the right, in its sole discretion, to terminate your account at any time, without notice. Termination of an account also includes forfeiture of all earnings and referrals. Causes for such termination shall include, but not limited to: breaches or violations of the terms or other incorporated agreements or guidelines; requests by law enforcement or other government agencies; a request by you (self-initiated account deletions); discontinuance or material modification to the Service (or any part thereof); unexpected technical or security issues or problems; and extended periods of inactivity, as set forth, above, in "Member Participation Terms." Spam/Damages EmailsForAds may immediately terminate any account which it determines, in its sole discretion, is transmitting or is otherwise connected with any 'spam' or other unsolicited bulk email. Past, present, and future earnings will be forfeited in such instances. In addition, because damages are often difficult to quantify, if actual damages cannot be reasonably calculated then you agree to pay EmailsForAds liquidated damages of five dollars ($5.00 USD) for each piece of 'spam' or unsolicited bulk email transmitted from or otherwise connected with your account. Otherwise you agree to pay EmailsForAds's actual damages, to the extent such actual damages can be reasonably calculated. Violations Please report any violations of the Terms of Service to our Customer Support.
