Last Updated: September 12, 2006 EmailsForAds is offered to you conditional to your acceptance, without modification on your part, of the terms and conditions contained herein. Your use of the EmailsForAds program constitutes your agreement to all such terms and conditions. Modification of These Terms of Service EmailsForAds reserves the right to change the terms and conditions without prior notification of its members. You are responsible for regularly reviewing these terms and conditions. Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with EmailsForAds. If any modification is unacceptable to you, you're only recourse is to terminate this agreement. Your continued participation in the EmailsForAds program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change. General EmailsForAds may provide you with notices, including those regarding changes to the terms, by either email, regular mail, or postings on the website. For advertisers that are not members of EmailsForAds, an advertiser account will be created for you. You will be able to view the advertisement statistics for your campaign(s) through your advertiser account. Once a payment has been received for an advertising purchase, the advertisement order will be processed within 14 days. If your advertisement is not processed within 14 days, you will be compensated either with a full refund or double your advertising order, at the sole discretion of the program owner. Exceptions include: not receiving the advertisement information, chargebacks, or refusal to run the advertisement for any reason. EmailsForAds will contact you via email when your advertisement has been processed. You may also be contacted if there will be a delay in processing your advertisement for any reason, or if your advertisement is refused for any reason. EmailsForAds reserves the right to disclose any personal information about you or your use of the EmailsForAds website/services, including its contents, without your prior permission if EmailsForAds has a good faith belief that such action is necessary to: conform to legal requirements or comply with legal process; protect and defend the rights or property of EmailsForAds; enforce the terms or service; or act to protect the interests of its members or others. EmailsForAds reserves the right to refuse an advertisement for any reason. EmailsForAds also reserves the right to edit any advertisement we deem inappropriate. Responsibility of Advertisers We do not allow race, hate, warez, adult, casino, pharmacy, chain letters, "investment" autosurfs, or illegal sites to be advertised through EmailsForAds. We abide by PayPal's Acceptable Use Policy. We will not accept javascript ads or activeX ads. We will not accept websites that contain Free20, Neoffic, CPABet, LuckPTP, DoBizWith, Doono or similar invisible iframes (5x5 or less) which cheat other websites and programs. We also do not allow Unsustainable/Unrealistic sites or any site boycotted by GPTBoycott.com: Your site and ad must be written in English for the general membership. Websites and advertisements written in a language other than English may be targetted to the countries who speak the language, however, an English translation must be provided. Once your advertisement has been processed, you will be emailed a username and password associated with your advertiser account, if you are not a current member of the EmailsForAds program. It is your responsibility to keep this information confidential. Furthermore, you are entirely responsible for any and all activities that occur under your account. You may update your information on file with EmailsForAds by logging in to your advertiser account and clicking the "My Info" link, or by clicking here. The information you provide about yourself must be true, accurate, current and complete and you may not assume a false identity. If you provide any information that is untrue, inaccurate, not current or incomplete, or EmailsForAds has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, EmailsForAds has the right to suspend or terminate your account, terminate any and all advertising campaigns running under your account, and refuse any and all current or future use of the EmailsForAds website/service (or any portion thereof). Privacy and Protection of Personal Information Please review the Privacy Policy at http://www.emailsforads.com/pages/privacy.php for disclosures relating to the collection and use of your personal information. Unlawful or Prohibited Use As a condition of your use of EmailsForAds, you will not use EmailsForAds for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use EmailsForAds in any manner that could damage, disable, overburden, or impair EmailsForAds or interfere with any other party's use and enjoyment of EmailsForAds. You may not attempt to gain unauthorized access to EmailsForAds or other accounts connected to EmailsForAds, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the EmailsForAds program. Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by EmailsForAds be detected it may result in member termination and possible legal action. Entire Agreement The Terms of Service constitute the entire agreement between you and EmailsForAds and govern your use of the program/services, superceding any prior agreements between you and EmailsForAds. Non-Transferable You agree that your EmailsForAds account is non-transferable. Any rights to your EmailsForAds username or contents within your account terminate upon your death. Links to Third Party Sites EmailsForAds may contain images of and links to third party websites. EmailsForAds is not responsible for the contents of any third party website, including without limitation any link contained in a third party website, or any changes or updates to a third party website. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. EmailsForAds shall not be responsible or liable for any part of any such dealings or promotions. Liability Disclaimer The information and services included in or available through EmailsForAds may include inaccuracies or typographical errors. Changes are periodically made to EmailsForAds and to the information therein. EmailsForAds may make improvements and/or changes at any time. EmailsForAds makes no warranty that the program/services will meet your requirements, the program/services will be uninterrupted, timely, secure, or error-free, the results that may be obtained from the use of the program/services will be accurate or reliable, and any errors in the software will be corrected. EmailsForAds will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or EmailsForAds program, even if EmailsForAds has been advised of the possibility of such damages. Furthermore, EmailsForAds aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement. Termination/Access Restriction You may cancel your account with EmailsForAds at any time by logging in to your advertiser account and clicking the "My Info" link, or by clicking here. Simply enter your password in the bottom box and press the button. EmailsForAds reserves the right, in its sole discretion, to terminate your account at any time, without notice. Termination of an account also includes forfeiture of all advertisements. Causes for such termination shall include, but not limited to: breaches or violations of the terms or other incorporated agreements or guidelines; requests by law enforcement or other government agencies; a request by you (self-initiated account deletions); discontinuance or material modification to EmailsForAds (or any part thereof); and unexpected technical or security issues or problems. Spam/Damages EmailsForAds may immediately terminate any account which it determines, in its sole discretion, is transmitting or is otherwise connected with any 'spam' or other unsolicited bulk email. Violations Please report any violations of the Terms of Service to our Customer Support.
